Mr. Consilvio is an associate in the Electronics group. His practice concentrates on patent prosecution and litigation at the United States Patent and Trademark Office (USPTO). His preparation and prosecution work has spanned a variety of technologies including optics, photolithography, metrology, flash memory devices, telecommunications, medical devices, and software-related inventions. As a former patent examiner, Mr. Consilvio brings his thorough knowledge of USPTO practice to bear in obtaining patent rights and advising his clients on relating issues. Mr. Consilvio has also has deep knowledge of and experience with Patent Office Litigation. Having been involved in more than three dozen inter partes reviews and covered business method patent reviews, Mr. Consilvio is well versed in all trial phases for both petitioners and patent owners. His representation has involved, for example, imaging sensing technology for driver assistance systems, wireless information distribution systems, environmental sensors, imaging sensing related to human-computer interaction, wearable sensors, gaming systems, and lighting devices. He has also regularly performs other patent-related work, e.g., related patent validity, patent infringement, due diligence, freedom-to-operate investigations, and client counseling.
Prior to his time at Sterne Kessler, Mr. Consilvio almost a decade examining patent applications. Mr. Consilvio’s area of specialty was optical systems and elements. This covered a broad range of linear and non-linear optical technologies, such as: microscopy (e.g., confocal, single or multi-photon, fluorescent, stereoscopic/surgical, etc.), telescopy, adaptive optics, optical and biomedical imaging systems, photography, MEMS mirrors, catadioptrics, photolithography, thin film/Bragg mirrors, polarization, antiglare, electrooptical and acoustootptical devices, display technology (BEFs, LEDs, LCDs, illumination systems, etc.), infrared/ultraviolet systems (e.g., filters, interference coatings, NVIR) and optical communications.
Mr. Consilvio is also a contributing author of Patent Office Litigation, Second Edition, published in 2017 by Thomson Reuters Westlaw, the book provides a fresh and comprehensive exploration of patent office litigation proceedings, including how the proceedings interact with other aspects of patent procurement and enforcement, while delivering practical analysis and advice.
During law school, Mr. Consilvio interned for the Honorable Peter J. Messitte at the U.S. District Court for the District of Maryland where performed clerking duties for multiple patent infringement suits. He also assisted in the preparation of text book on patents and the pharmaceutical industry.
