Sterne Kessler Files First Petition for Inter Partes Review for a Pharmaceutical Company

On October 4, 2012, Sterne Kessler filed a Petition for Inter Partes Review ("IPR") on behalf of its client Apotex Inc. with respect to United States Patent 6,716,830. This October 4th filing is the first IPR petition ever filed on behalf of any pharmaceutical company. The case has been assigned trial number IPR2013-00012, and a copy of the petition can be downloaded above or found here.
Because of the speed with which IPRs are adjudicated, these proceedings may be more attractive to patent challengers involved in concurrent litigation than were inter partes reexamination proceedings.
